General trading conditions X-TUNE

1. Area of application of the general trading conditions

The supplies and achievements of x-tune (Robert-Leicht-Straße 128, 70569 Stuttgart) exclusively take place due to the following general ones supply and trading conditions (AGB), which are obligatory on future business also. Deviations from this AGB `s, as well as verbally met arrangements, are effective only after express written confirmation. With the order the AGB´s applies as accepted.

2. Offer and order

The offers of x-tune (Robert-Leicht-Straße 128, 70569 Stuttgart) are always not-binding. Misprint, mistakes we reserve ourselves. All orders require a written confirmation by us. The sales contract comes off only with this confirmation. As confirmation the goods delivery with delivery note and/or calculation or the dispatch of a confirmation of order is considered. Verbal or telephone agreements are obligatory only if they were confirmed later in writing.

3. Prices and payment

All prices specified by us are gross prices inclusive. at present valid legal value added tax, additionally the transport costs are computed. Payments of orders for small quantity can take place only by Vorkasse. Terms of payment for all other orders are fixed on the respective offers of x-tune (Robert-Leicht-Straße 128, 70569 Stuttgart) and on the confirmation of order.

4. Mode of shipment and costs

The choice of the mode of shipment and the transit period remains reserving the salesman, if not expressly something else one agreed upon. In the case of supplies within Germany (without islands) as basis forwarding expenses of the German post office are set from at present Eur 6.70 (parcel to 5 kg). In the case of cash on delivery supplies additionally Eur 4.00 introduction payment and Eur 2.00 transmission payment result. Starting from a commodity value of E 2000.00 we supply forwarding expenses-free. Forwarding expenses for supplies outside of Germany and the island regions are individually computed after weight and commodity value and should be inquired in your own interest at us by telephone.

5. Delivery times

The delivery time for articles, which are at the camp (camp commodity), amount to approx. 2-3 working-days. Delivery times for article, those not at the camp are available the customer before conclusion of the sales contract are not communicated.

6. Higher force

If events occur, which prevent us from the supply, but lie outside of our influence, the time for delivery extends, until the cause of impediment does not exist any longer. If preventing lasts longer than 6 months, the buyer is entitled to withdraw from the contract. Requirements for compensation are impossible. This applies also in case of from strike, scarcity of raw materials and other operational disturbances, which obstruct us at the supply unreasonably.

7. Guarantee

On all articles the usual legal warranty claims apply. All, of x-tune delivered parts were examined on your function and evaluated as error free. A return of articles can be only agreed if x-tune this recognizes as defectively delivered. For adhesion and follow-up damage with the enterprise of and with our products we cannot be sued, since a normal enterprise or employment cannot be supervised by us. Returns go having at expense of the client and stehts freely to take place.

8. Goods cancelling

The cancelling of commodity in lack-free condition, unused and in lack-free packing is in principle at any time possible. According to remote delivery law you have an unrestricted return right of the ordered articles within 14 days. The invoice date of the supply and the post office input information of your return are determining. Returns at expiration of this time require our written agreement. The commodity is to be sent back generally freely to x-tune (Robert-Leicht-Straße 128, 70569 Stuttgart). An acceptance of unfreely sent back goods is rejected. The original invoice or a well readable copy of the calculation is to be attached to the return. The repayment of the purchase price takes place with return (return) within 14 days and lack-free condition of the commodity at height of the commodity value according to calculation.

9. Data security

The managing trading conditions exclusively apply to the enterprise X-TUNE (owner Phillip Mertens, Robert-Leicht-Straße 128, 70569 Stuttgart). If individual clauses and parts of the clauses of these trading conditions are invalid, then all other clauses remain valid.
